Dead Mile is made and operated by Virtual Verse Studio (Virtual Verse Studio LLC) — “we”, “us”. These terms are the agreement between you and us for playing it. By installing or playing Dead Mile you accept them. If you do not, do not play.
Your privacy is covered separately, at virtualverse.studio/privacy/dead-mile.
Who can play
Dead Mile is not made for children. You should be at least 13 years old (or the minimum age where you live, if it is higher) to play. If you are under 18, please make sure a parent or guardian is happy with these terms and with the fact that the game sells in-app items.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install and play Dead Mile on devices you own or control, for your own entertainment. We keep ownership of the game and everything in it — the code, the art, the audio, the writing, the characters and the name.
You may not sell, rent, sub-licence or redistribute the game; reverse-engineer, decompile or modify it, except where the law says you may despite this; or use cheats, bots, modified clients or exploits to change how the game behaves for you or anyone else.
In-game currency and items
Dead Mile contains Gems, Coins, Power Points, Fuel, characters, items and defences. All of them are part of the game, not property.
- They have no real-world value and cannot be exchanged for money, goods or anything outside the game.
- We licence them to you, we do not sell them to you. Your licence to use them lasts as long as your installation does.
- They cannot be traded or transferred to another player or another installation.
- They are tied to your installation. There is no account, so deleting the game or losing the device ends your access to everything the save held, and we cannot restore it. Purchases you made with real money can be restored — see below — but the balances and progress cannot.
We may change what items cost, what they do, and how much of anything a player receives, as part of balancing the game.
Purchases
Real-money purchases in Dead Mile are made through the Apple App Store or Google Play. We never handle your payment. The transaction, the receipt and the refund are between you and the store.
- Refunds are the store's decision, under Apple's or Google's own policy. We cannot issue, reverse or block one.
- Non-consumable purchases can be restored. The Survivor's Kit and Hazard Pay are tied to your store account, and RESTORE in the shop brings them back on a new install. Gems and other consumable purchases are spent when they are granted and cannot be restored.
- Prices are set per country by the store and may change.
Advertising
Dead Mile is free because it shows advertising. Watching an ad is how several rewards are earned, and a short ad appears between some runs.
No purchase removes advertising, and nothing in the shop claims to. What you can buy is convenience — faster play, better rewards — never fewer ads.
Ads come from third-party networks. We choose the settings that keep them appropriate for the game's age rating, but we do not create the ads and we do not control every advertiser. If you see an ad you think does not belong in Dead Mile, email us and tell us which one — that is genuinely useful and we act on it.
Playing online
Dead Mile includes an arena where you are matched against another player's squad. When you play it:
- Choose a name others can see. Do not use anything obscene, hateful, threatening, impersonating, or that contains someone's personal information. We may change or remove a name that breaks this, and may stop a player from using the arena.
- Do not attempt to interfere with matchmaking, the ladder, or another player's game.
- The arena depends on a server. It may be unavailable, and we may change or end it.
Availability and changes
We may update, change or stop supporting Dead Mile, or any part of it, at any time. We may add, remove or rebalance content. Online features in particular depend on servers we may take down.
We may update these terms. If we do, we will change the date at the top, and we will say so in the game when the change matters.
Ending it
You can end this agreement whenever you like, by deleting the game.
We may suspend or end your access if you break these terms — for example by cheating, exploiting, or abusing other players. Where it is fair to do so, we will warn you first.
No warranty
Dead Mile is provided as it is. We do not promise it will be uninterrupted, error-free, or that it will work on every device. Nothing here takes away rights you have under consumer law where you live, and if your local law gives you a guarantee we cannot exclude, that guarantee still applies.
Our liability
To the extent the law allows, we are not liable for lost progress, lost purchases, lost data, lost profits, or any indirect or consequential loss arising from playing Dead Mile.
Where we are liable and the law does not allow us to exclude it, our total liability to you is limited to the amount you actually paid us — through the stores — in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Governing law
These terms are governed by the law of the State of Delaware, United States, and disputes go to the courts of the State of Delaware. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.
The stores
Apple and Google are not parties to these terms and have no obligation to support Dead Mile. The agreement is between you and us. Where Apple's standard terms for licensed applications apply, they apply in addition to these, and Apple is a third-party beneficiary entitled to enforce them.
